Regulatory Enforcement and Sanctions Act 2008

A key concern of business identified by the 2005 Hampton Review ‘Reducing administrative burdens: effective inspection and enforcement’ was the lack of consistency and coordination in local authority regulatory services. Set up by the Government in May 2007, LBRO's role is to improve local authority enforcement of environmental health, trading standards and licensing – reducing burdens on businesses that comply with the law while targeting those who flout it.

Philip Preece is the lead officer for Health and Safety issues in the LBRO, was previously the Team Leader for Health and Safety Enforcement with Birmingham City Council and, prior to that, was a HSE Inspector.

This new Act will result in Local Authority functions being significantly affected, with changed relationships with LBRO, Environmental Health Offices, Trading Standards, Licensing and Fire Regulation.

On the benefit side, for firms, will be the establishment of Primary Authorities across LA Boundaries, so that firms operating in different areas will only have to work to one set of guidelines, giving greater geographical consistencey. On the other side, there will be new on the spot and discretionary penalties, stop notices and restoration notices.

Falls from Vehicles

Every month over a thousand people suffer serious injuries as a result of slips, trips or falls in the workplace. These shattering injuries can be avoided by sensible and proportionate management of the risks and this simple rationale is what triggered off HSE’s “Shattered Lives” Campaign. As part of this National Campaign, HSE has also launched an intensive campaign aimed at reducing falls from vehicles. Nina has been working on this subject for some years and has accumulated a wealth of practical knowledge on which she will draw for today’s presentation.
